In this case, the family is entitled to the compensation as meant in Article 7, because Lufthansa, a Community airline, is operating the flight, in accordance with Article 3 paragraph 1. None of the exceptions under Article 5 paragraph 1 sub c and paragraph 3 apply. That is, in her correspondence Lufthansa does make an appeal to the extraordinary circumstances of Art. 5 paragraph 3. However, despite repeated request, she refuses to demonstrate this in the sense of Art. 5 paragraph 3.
