ArkeFly cancellled flight OR 460 from Fortaleza to Amsterdam, or at least the flight was not executed on that day. De flight was executed three days later at 3:34 am, with a delay of about 54 hours. The passenger landed in Amsterdam about 75 hours later than originally agreed in the contract of carriage. In order to ensure the rights of passengers, in the view of EUclaim, under these circumstances this long delay should be regarded as a cancellation in the meaning of the Regulation with the right to financial compensation.
ArkeFly is of the opinion that this is not a cancellation as mentioned in the Regulation, but a very long delay. ArkeFly claims not to be liable to compensate this passenger in any way.
