Flight HV 445

In this case, the passenger reported at the check in desk of flight HV 445 at Schiphol Airport.The passenger was not allowed to check in. The flight was cancelled. The passenger was rerouted to another flight from Amsterdam Schiphol Airport. The Regulation applies to the passengers under Atricle 3.2 sub a) or b). On the basis of Article 5 Transavia should compensatie them in accordance with Article 7. because the flight distance was 1241 kilometres and the new time of arrival was 9 hours later than the original arrival time, compensation amounts to € 250 per person (Article 7.1 sub b).
In her letter dated 24 January 2008, Transavia states that the flight was cancelled because of extraordinary circumstances which could not have been avoided, even if all reasonable measures had been taken. On 4 july 2007, two of Transavia's aircraft were struck by lightning. According to Transavia, this disturbance in the rotation has caused the cancellation of flight HV 445 three days later, since Transavia had to make new flight schedules.
